Your rights and obligations when using Pathlog family location sharing services

Welcome to Pathlog. These Terms and Conditions ("Terms") govern your use of the Pathlog mobile application and related services (collectively, the "Service") provided by Track My Ride Pty. Ltd. ABN 71 617 307 570 ("Pathlog", "we", "us", or "our").

Pathlog is a privacy-focused family location sharing service. We keep it simple: no ads, no data selling, no complex features - just reliable location sharing for families who want to stay connected safely.

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our Service.

CRITICAL CONSENT NOTICE

All persons being tracked must provide explicit consent. Using Pathlog to track anyone without their knowledge and consent may constitute stalking, harassment, or other criminal offences under applicable laws.

For children under 18, consent must be provided by a parent or legal guardian. Any family member may withdraw consent and request removal at any time.

You are solely responsible for obtaining and maintaining proper consent from all tracked persons.

1. Agreement to Terms

1.1 Acceptance. By creating an account, downloading our app, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2 Updates to Terms. We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.

1.3 Entire Agreement. These Terms, together with our Privacy Policy and any subscription terms through the Apple App Store or Google Play Store, constitute the entire agreement between you and Pathlog.

2. Eligibility

2.1 Age Requirements. You must be at least 18 years old to create a Pathlog account and subscribe to our Service. By creating an account, you represent and warrant that you meet this age requirement.

2.2 Family Members. Family members of any age may be added to your family group, but:

  • Children under 13 may only be added by their parent or legal guardian
  • Teenagers aged 13-17 require parental consent to be tracked
  • All adults (18+) must provide their own consent to join a family group

2.3 Authority. You represent that you have the legal authority to enter into these Terms and to provide any required consents for family members you add to your account.

3. Accounts and Family Groups

3.1 Account Creation. To use Pathlog, you must create an account using accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Family Groups. As the primary account holder, you may create a family group and invite members based on your subscription tier:

Subscription Tiers:

  • Tier 1: Up to 3 members total (including yourself) - Perfect for small families
  • Tier 2: 4 to 10 members total - Ideal for larger families or extended family groups

3.3 Member Management. As the primary account holder, you can:

  • Invite family members via email or SMS
  • Remove members from your family group
  • Manage notification settings for the group
  • Set up safe zones and location alerts

3.4 Account Security. You must immediately notify us of any unauthorised use of your account. You are responsible for all activities that occur under your account.

4. Service Description

4.1 Core Features. Pathlog provides the following features:

  • • Arrival/departure notifications
Safety Features
  • • Custom safe zones (geofencing)
  • • Alert notifications
  • • Custom profile pictures

4.2 Required Permissions. To function properly, Pathlog requires:

  • Location Services: Always Allow (for continuous tracking)
  • Notifications: To send arrival/departure alerts
  • Background App Refresh: For location updates when app is closed
  • Cellular Data/Wi-Fi: For syncing location data

You can manage these permissions in your device settings, but limiting them may affect app functionality.

4.3 Service Limitations. Pathlog is designed for simple, privacy-focused location sharing. We do NOT provide:

  • Crash detection or emergency response
  • Driving reports or analytics
  • In-app messaging or chat
  • Journey replay features
  • Roadside assistance
  • Crime or safety reports

4.4 Future Features. We may introduce new features over time. Any future features (such as emergency SOS) will be subject to additional terms and limitations that we'll communicate when launched.

4.5 Service Availability. While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Location accuracy depends on device GPS capabilities and network conditions.

4.6 Technical Limitations. Please be aware of these technical considerations:

  • Location accuracy varies based on GPS signal, device capabilities, and network coverage
  • Continuous location sharing may impact device battery life
  • Location services must be enabled and app permissions granted
  • Power-saving modes may affect real-time tracking accuracy
  • Indoor locations may have reduced accuracy

4.7 Geographic Availability. Service currently available in Australia only. We plan to expand internationally, and terms may be updated to reflect local laws and requirements when we launch in new regions. Check our website for current availability.

5. Payment and Subscriptions

5.1 Subscription Required. Pathlog is a paid service with no free tier. You must maintain an active subscription to access our Service.

Simple, Transparent Pricing:

Unlike other services, we keep it simple with just two tiers:

  • Tier 1: Up to 3 members (perfect for couples with one child)
  • Tier 2: 4-10 members (ideal for larger families)

No hidden features, no complex matrices, no upsells. Everyone gets the same features.

5.2 Payment Processing. All payments are processed through:

App Store Payments Only

  • Apple App Store (for iOS devices)
  • Google Play Store (for Android devices)

We do not process payments directly. All billing inquiries should be directed to Apple or Google.

5.3 Subscription Terms.

  • Subscriptions automatically renew unless cancelled
  • You may upgrade or downgrade tiers at any time
  • Changes take effect at the next billing cycle
  • No partial refunds for tier downgrades

5.4 Cancellation. You may cancel your subscription at any time through your device's app store settings. Access continues until the end of your current billing period.

5.5 Refunds. Refund policies are governed by Apple App Store or Google Play Store terms. We do not directly process refunds.

7. Privacy

7.1 Privacy Policy. Your use of our Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review our Privacy Policy at pathlog.com/privacy.

7.2 Key Privacy Points.

  • We do not sell your personal or location data
  • Location data is only shared within your family group
  • You can access, correct, or delete your data anytime
  • We comply with Australian privacy laws

7.3 Consent. By using Pathlog, you consent to the data practices described in our Privacy Policy. You confirm that all family members have consented to location sharing.

8. User Conduct and Restrictions

8.1 Acceptable Use. You agree to use Pathlog only for lawful family location sharing purposes as intended.

8.2 Prohibited Conduct. You must not:

  • Use the Service for any illegal or unauthorised purpose
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorised access to any portion of the Service
  • Reverse engineer, decompile, or disassemble the app
  • Remove, obscure, or alter any legal notices
  • Use automated systems to access the Service
  • Impersonate another person or entity
  • Share your account credentials (except with authorised family)
  • Use the Service to harm minors in any way

8.3 Enforcement. We reserve the right to investigate and terminate accounts violating these Terms, and to involve law enforcement when appropriate.

9. Intellectual Property

9.1 Ownership. Pathlog and its licensors retain all rights, title, and interest in the Service, including all intellectual property rights.

9.2 Limited Licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial family tracking purposes.

9.3 User Content. You retain ownership of content you upload (such as profile pictures). By uploading content, you grant us a licence to use it to provide the Service.

9.4 Feedback. Any feedback or suggestions you provide may be used by us without compensation or attribution.

10. Disclaimers and Warnings

SERVICE PROVIDED "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.1 No Emergency Service. IMPORTANT: Pathlog is NOT an emergency service. For emergencies, always call 000 (Australia) or your local emergency number. We do not monitor for emergencies, provide emergency response, or contact emergency services.

10.2 Accuracy Limitations. Location data may be inaccurate due to:

  • Poor GPS signal or device limitations
  • Network connectivity issues
  • Device battery saving modes
  • User privacy settings

10.3 Third-Party Services. We are not responsible for third-party services, including app stores, device manufacturers, or network providers.

10.4 No Professional Advice. Pathlog does not provide safety, security, legal, or professional advice of any kind.

11. Limitation of Liability

11.1 No Consequential Damages. Pathlog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use.

11.2 Liability Cap. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11.3 Exceptions. Some jurisdictions don't allow limitation of liability, so these limitations may not apply to you.

11.4 Basis of Bargain. You acknowledge that Pathlog has offered the Service in reliance upon the limitations of liability set forth herein.

12. Indemnification

12.1 Your Indemnification. You agree to indemnify, defend, and hold harmless Pathlog, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws
  • Any claim that you tracked someone without proper consent
  • Your negligent or wrongful conduct

12.2 Defence and Settlement. We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you.

13. Termination

13.1 Termination by You. You may terminate your account at any time by:

  • Cancelling your subscription through the app store
  • Deleting your account in the app settings
  • Contacting [email protected]

13.2 Termination by Pathlog. We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You use the Service illegally or without proper consent
  • We receive complaints about unauthorised tracking
  • Required by law or court order
  • You fail to pay subscription fees

Effects of Termination:

  • • All location tracking immediately stops
  • • Family members lose access to shared locations
  • • Your data is retained for 90 days then deleted
  • • No refunds for unused subscription time

13.3 Survival. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and general provisions survive termination.

14. General Provisions

14.1 Governing Law. These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.

14.2 Dispute Resolution Process.

We prefer to resolve issues directly:

  1. Contact Us First: Email [email protected] with your concern
  2. Good Faith Discussion: We'll respond within 5 business days to discuss
  3. Mediation: If needed, we'll suggest informal mediation
  4. Arbitration: If unresolved after 30 days, either party may pursue arbitration

Most issues can be resolved through simple communication.

14.3 Arbitration. If disputes cannot be resolved through the above process, they shall be settled through binding arbitration in Queensland, Australia. You may assert claims in small claims court if eligible.

14.4 Severability. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

14.5 No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

14.6 Assignment. You may not assign these Terms without our consent. We may assign our rights to any successor or acquirer.

14.7 Electronic Communications. You consent to receive electronic communications from us. These satisfy any legal requirement for written communications.

14.8 Entire Agreement. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Pathlog regarding the Service.
